Request for Public Comment on Amendments to Sections 100.19 and 100.21 of Commissioner’s Regulations for the Federally Approved Reimagine PhaseÌýÌý

The 51·çÁ÷ (NYSED) is accepting public comment on amendments to Sections 100.19 and 100.21 of Commissioner’s Regulations through April 28, 2025. In alignment with the federally approved amendments to the accountability section of the 51·çÁ÷ State consolidated State plan under the Every Student Succeeds Act (ESSA), the approved amendments initiate the first part of the Reimagine Phase of the accountability system, which will begin inÌýthe 2025-26 school year using 2024-25 school year results.Ìý

The United States Education Department (USED) approved amendments to the accountability section of the 51·çÁ÷ State ESSA plan on January 8, 2025. The approved 51·çÁ÷ State ESSA plan can be found on the Approved 51·çÁ÷ State ESSA Plan page.

At the February 2025 Board of Regents meeting, were approved under emergency action. Public comments on the amendments to Commissioner’s Regulations will be accepted through April 28, 2025, via email to RegComments@nysed.gov

Upon public comment review, amendments to Sections 100.19 and 100.21 will be presented for permanent adoption at the June 2025 Board of Regents meeting.

NYSED has released a series of informational fact sheets about 51·çÁ÷ State’s accountability system Reimagine Phase to provide general overviews of:

  • the transition from the Rebuild Phase, which applied to the 2023-24 and 2024-25 school years, to the Reimagine Phase;ÌýÌý
  • major components of the Reimagine Phase accountability system;ÌýÌý
  • accountability support model identification and exit criteria; andÌýÌý
  • accountability indicators.Ìý
